Terms of Use

1. Who we are
Noqta Platform ("Noqta", "we", "us") is a product of AtharCo, registered in Ramallah, Palestine. Noqta provides an operating platform for restaurants, vans, and carts — including QR menus, kitchen-display software, point-of-sale, dashboards, and loyalty.
2. Who these terms apply to
These Terms of Use apply to:
- Operators — owners, managers, staff, and kitchen team members of restaurants and venues that use Noqta to run their operations.
- Diners — customers who place orders via a QR menu or other Noqta surface at a venue that uses the platform.
The contract between a venue and Noqta (the Restaurant Services Agreement) governs the commercial relationship; these Terms govern day-to-day platform usage by everyone.
3. The product
Noqta is a webapp. It runs in a browser and requires an internet connection during operation. We do not currently support offline operation; tickets and orders flow through our servers in real time. We do not provide hardware. We may help operators source compatible hardware (printers, tablets) but we do not service it.
4. Operator responsibilities
By using Noqta, the operator agrees to:
- Operate the platform in good faith — accurate menu data, accurate prices, accurate order status.
- Train their team to use the product responsibly. Staff who handle customer data must understand basic privacy hygiene.
- Configure the platform per the venue's local laws (VAT, receipt requirements, food-safety obligations).
- Pay subscription fees on time per the Restaurant Services Agreement.
5. Acceptable use
Noqta may not be used to:
- Place fraudulent orders or solicit payment without intent to deliver.
- Store data the operator is not legally permitted to collect.
- Reverse-engineer, scrape, or attempt to disrupt the platform.
- Resell access to the platform without written permission.

6. Customer / diner data
Diner data (names, phone numbers, order history, loyalty balances) belongs to the venue, not to Noqta. Noqta is a data processor; the venue is the data controller. Diners interacting with a venue's QR menu are entering into a relationship with the venue, not with Noqta directly. Our role is to provide the tools.
7. Availability and changes
We aim for the platform to be available during venue service hours. We may schedule maintenance windows; we will give reasonable notice when possible. We may change features over time. Material changes that affect the operator workflow will be communicated in advance.
8. Liability
Noqta is provided "as is". We do not guarantee that the platform will be uninterrupted or error-free. We are not liable for lost revenue caused by service interruption, hardware failure (including printers and devices we do not provide), or third-party network issues. The operator's only remedy for service problems is the support process described in the Restaurant Services Agreement.
9. Termination
The operator may end their subscription per the cancellation terms in the Restaurant Services Agreement. Upon termination, the operator can export their data. Noqta will retain the data for 30 days after termination for recovery purposes, then delete it on request.
10. Governing law
These Terms are governed by the laws of Palestine. Disputes are heard in Ramallah courts.
